Discrimination
The Discrimination Ordinance encompasses a range of legal protections designed to prevent unfair treatment of individuals based on certain protected characteristics. These characteristics typically include age*, disability, gender reassignment, marriage and civil partnership, pregnancy and maternity, race, religion or belief, sex*, and sexual orientation.
The aim of discrimination law is to promote equality and ensure that everyone has the opportunity to participate fully in society without facing prejudice or bias. The law prohibits direct discrimination, where someone is treated less favourably because of a protected characteristic, as well as indirect discrimination, where a seemingly neutral policy disproportionately impacts certain groups. Harassment and victimization related to these characteristics are also forbidden.
Discrimination laws apply in various contexts, including employment, education, housing, and the provision of goods and services. Employers and service providers have a legal duty to take reasonable steps to accommodate individuals’ needs and to prevent and address discrimination. Enforcement of these laws typically involves complaints and investigations by relevant authorities, and individuals who believe they have been discriminated against may be able to seek legal remedies through courts or tribunals.
*Age and Sex Discrimination are to be enacted as Phase 2 of the Discrimination Ordinance. Sex Discrimination is currently on covered in an employment context by the Sex Discrimination (Employment) (Guernsey) Ordinance, 2005.
