Nick specialises in disputes involving complex international trust and corporate structures. He acts for and advises: trustees, beneficiaries and other parties to trusts; directors, shareholders and other corporate stakeholders. He acts in trust administration proceedings. He also has extensive experience of commercial litigation and of regulatory matters.

Trusts (contentious and non-contentious)

  • Acting on behalf of an advisory company and its director in a claim valued at £160m against the directors of a Guernsey SPV which had been engaged in the development of landmark, London residential properties.
  • Acting on behalf of trustees of a Jersey trust in multiple proceedings before the Royal Court of Guernsey and the Guernsey Court of Appeal in claims against the former trustees of the trust. The two primary claims (which are valued at £380m and £160m) are the subject of appeals to the Privy Council.
  • Acting on behalf of the Guernsey trustee of a pension scheme which had been established by a well-known, Premier League club, in relation to proceedings before the High Court Family Division in London.
  • Acting on behalf of beneficiaries of a Guernsey trust in an application to vary the trust to remove the settlor’s “reserved powers” under the trust deed. The application was one of the largest trust variations in Guernsey history.
  • Acting on behalf a FTSE 100 company (with annual turnover in excess of £2billion) engaged in the provision of architectural, M & E consultant and project management services, in Guernsey’s largest ever construction dispute involving allegations of professional negligence and breach of contract.
  • Acting on behalf a Luxembourg company in proceedings against entities in the BVI and Italy, and relating to the funding of a large-scale development in the Czech Republic. The matter involved complex matters of English, Italian, BVI, Guernsey and Czech law, including as to forum and jurisdiction, and novel points of private international law which had not previously been decided in Guernsey.
  • Acting on behalf of the majority shareholder of a leading, international construction company in proceedings involving trust and corporate structures registered in Guernsey, Cyprus, Greece, Liechtenstein, the UK and BVI.
  • Acting on behalf of a minority shareholder of a Guernsey-registered SPV engaged in the development of a landmark London hotel in proceedings involving allegations of unfair prejudice, breach of duty and breach of contract. The proceedings involved trust and corporate structures registered in Spain, Guernsey, the UK and UAE.
  • Acting on behalf of the beneficial owner and the directors of nine Guernsey-registered property development companies in proceedings involving allegations of breach of contract, breach of duty, knowing receipt and improper dealing, arising from developments across the UK and Europe with an estimated value in excess of £5billion.
  • Acting on behalf of a discretionary object of a Guernsey trust in a dispute involving allegations of forgery, breach of duty and fraud and arising from concurrent proceedings in the Dutch Antilles.
  • Acting on behalf of the trustees of retirement annuity trust schemes in financial mis-selling claims against the schemes’ investment advisors.
  • Regularly appointed by the Royal Court of Guernsey to act on behalf of minor and unborn beneficiaries of Guernsey trusts in Public Trustee v Cooper (and similar) proceedings.

Nick qualified as a Solicitor in New South Wales in 2004 and in England in 2010. He gained valuable dispute resolution experience practising commercial litigation in Sydney and London before joining Babbé LLP in 2010. He re-qualified as a Guernsey Advocate in 2012, was made a Partner in the Dispute Resolution team in 2016 and became Babbé's Managing Partner on 1 June 2021.
