Can AI Give Legal Advice? The Risks of Relying on AI Instead of a Qualified Lawyer

2 Min Read

Artificial Intelligence (AI) is transforming industries, but when it comes to law, caution is essential. AI tools often generate answers that sound convincing but can be factually incorrect or outdated. Why? Because AI predicts patterns based on training data—it doesn’t verify facts or truly understand context.

This means nuanced legal questions can lead to misleading answers. And because AI presents responses confidently, spotting errors isn’t always easy.

The Risks of Relying on AI for Property Transactions

Property law is complex and jurisdiction-specific. AI systems often rely on static datasets, which may not reflect current legislation or local exemptions. Using AI for legal decisions without expert review can result in costly mistakes.

Guernsey Property Law: Why DocuSign Doesn’t Apply

A common misconception—sometimes even suggested by AI—is that electronic signatures like DocuSign can be used for signing Conditions of Sale in Guernsey. This is incorrect.

The Electronic Transactions (Exemptions) Order, 2001 Explained

Under Guernsey law, the Electronic Transactions (Exemptions) Order, 2001 provides that sections 1 to 5 and 8 of the Electronic Transactions Law, 2000 do not apply to:

“the conveyance of real property or the transfer of any interest in real property, including any contract prior thereto.”

This means electronic signatures cannot be used for property conveyancing or related contracts in Guernsey. Compliance requires traditional signing methods.

Expert Advice vs AI: What You Need to Know

AI is a helpful tool for research, but it cannot replace professional judgment. Legal advice must be accurate, up-to-date, and tailored to local law. For property transactions, relying solely on AI could put your deal—and your compliance—at risk.
