Guernsey has long been committed to meeting international standards aimed at confronting financial crime, including those relating to the transparency as to the natural persons who ultimately own or control legal persons. Continuing with such commitment, the States have now issued draft legislation for the establishment of a register of beneficial ownership information (the “Register”). The draft legislation, which will aim to provide the technical detail for the establishment of the Register, is currently at the consultation stage.


Sanctions regimes across the globe are ever-changing, placing a significant burden upon businesses to remain informed as to the identities of the nations and entities affected by those regimes.

The introduction of a new arbitration law in Guernsey has been expected for some time, with Guernsey’s current legislation being perceived as out of date and failing to properly facilitate an effective and efficient process. It is hoped that The Arbitration (Guernsey) Law 2016 (“the 2016 Law”) will address the shortfalls of the present legislation and encourage more parties to arbitrate their disputes in Guernsey.
